The IR35 rules can be used where an individual deals with an intermediary, like their own personal services company (PSC). The individual’s task will be kept “inside IR35” if it is settled that if the intermediary did not subsist that individual will be treated as an employee of the hiring client.

Where it is an inside IR35 assignment, the payment to the PSC will be considered as earnings/employment income so the intermediary will be able to deduct tax and NICs when payment is disbursed to the individual. In the public sector further step is initiated from 6April 2017, the off-payroll rules need that the public sector client make a review of the IR35 status.
